Kerala HC Quashes Case For Waving Black Flag At CM Pinarayi Vijayan

Kerala HC Quashes Case For Waving Black Flag At CM Pinarayi Vijayan

The Kerala High Court quashed a case against a man charged with a black flag at Chief Minister Pinarayi Vijayan as his convoy passed. The incident took place on April 9, 2017, and the person was accused of cases like posing a danger or obstruction in a public way, disobedience to the order of a public servant, defamation, and assault.

A single bench of Justice Bechu Kurian Thomas said|: “Though signs and visible representations can be a mode of defaming a person, still showing or waving a black flag to a person cannot amount to defamation nor is it an illegal act. Even if a black flag was shown to the Chief Minister’s convoy, such conduct cannot by any stretch of the language of Section 499 of the IPC be perceived as defamatory. In this context, this Court considers that a black flag can depict different things depending on the context. Waving a flag can be a sign of support or protest. It is a matter of perception. Generally, a black flag is shown as a mark of protest. If a flag of a particular colour is shown, whatever the reason, including as a mark of protest, as long as there is no law which prohibits the waving of a flag simpliciter, such conduct cannot be mulcted with the offence of defamation.”

The intention behind the IPC’s Section 95 (act causing simple harm) IPC is to avoid penalising negligible wrongs or trivial offences, the court said, adding that if prosecution is initiated for every triviality, “we will have time only for those”. “Section 95 comes to the aid in such instances. Considering the circumstances that none of the other offences is attracted and only Section 353 IPC remains, this court is of the view that having regard to the nature of allegations and in the absence of any assault or injury on the police officers and since the duty of the police officers was not deterred, Section 95 IPC can be applied to quash the offence under Section 353 IPC,” it added. The court concluded that it found no offences as alleged in the final report and quashed it.

Centre Launches Portal For Nurturing Skill Development In Underprivileged Kids

On Thursday, the Centre inaugurated the ‘Viksit Bharat Initiative for Student Innovation and Outreach Network’ (VISION) portal to nurture education, skill development, and innovation among underprivileged children in India. Reaching out to underprivileged youngsters helps democratise startup skills, said Union Minister of State (Independent Charge) Science and Technology Dr Jitendra Singh, while launching the portal in the national Capital on Thursday.

Dr. Jitendra Singh lauded the entrepreneurial vision behind the initiative and its focus on democratising opportunities for students across the country. He emphasised how the portal could be a gateway for those in remote areas to access mentorship and training. “An initiative like VISION provides an opportunity for even the most underprivileged to get a feel of what is happening in the mainland,” the minister remarked, symbolising the broader effort to make the startup ecosystem accessible to all. Citing the success achieved by students from remote areas, often without access to libraries or coaching centres, Dr. Jitendra Singh underscored the role of technology and initiatives like VISION in bridging gaps between urban and rural India.

He also praised the flexibility offered by the National Education Policy (NEP) 2020, which allows students to combine diverse subjects and pursue unconventional career paths. “This policy ensures that students are no longer prisoners of the subjects their parents chose for them,” he said, pointing out how this freedom can drive innovation and create new opportunities for India’s youth.

The minister also expressed optimism about India’s future as a hub for innovation and entrepreneurship. He stated that initiatives like VISION are integral to realising the country’s aspirations under Vision India 2047, which aims to position India as a global leader in technology, education, and economic growth.

Every Nation Must Embrace Buddhist Doctrine Of Peaceful Co-Existence: Rajnath Singh At ASEAN Meeting

Every Nation Must Embrace Buddhist Doctrine Of Peaceful Co-Existence: Rajnath Singh At ASEAN Meeting

Defence Minister Rajnath Singh on Thursday pitched for the Buddhist doctrine of peaceful co-existence at the ASEAN Defence Ministers’ Meeting in Laos. “The Buddhist doctrine of peaceful co-existence must be embraced more closely by all the nations as the world is increasingly getting polarised into blocks and camps, which is leading to increasing strain on the established world order,” said the Defence Minister while addressing the 11th ASEAN Defence Ministers’ Meeting-Plus forum in Vientiane, Lao PDR.

Rajnath Singh added that India stands for freedom of navigation and overflight, unimpeded lawful commerce and adherence to international law for peace and prosperity in the Indo-Pacific. “India has always advocated and practised dialogue for resolving complex international issues. This commitment to open communication and peaceful negotiation is evident in India’s approach to a wide range of international challenges, from border disputes to trade agreements,” the Defence Minister said. He added that an open dialogue promotes trust, understanding, and cooperation, laying the foundation for sustainable partnerships. “The power of dialogue has always proven effective, yielding tangible results that contribute to stability and harmony on the global stage. India believes that genuine, long-term solutions to global problems can only be achieved when nations engage constructively, respecting each other’s perspectives and working toward shared goals in the spirit of cooperation,” the Defence Minister said.

He said that the ASEAN region, in particular, has always been economically dynamic and bustling with trade, commerce and cultural activities, adding that all through this transformational journey, India has remained a trusted friend of the region. Citing a quote by Gurudev Rabindranath Tagore, while he visited South East Asia in 1927, the Defence Minister said, “Everywhere I could see India, yet I could not recognise it.” The Defence Minister also stressed that the statement symbolises the deep and widespread cultural and historical ties between India and South East Asia. Sharing his insights on the discussions on the Code of Conduct, Rajnath Singh said: “India would like to see a Code that does not prejudice the legitimate rights and interests of nations which are not party to these deliberations. The code should be fully consistent with international law, in particular the UN Convention Law of Sea 1982.” In view of the natural disasters wreaking havoc in different parts of the world, the Defence Minister said that it reminds of the perils of climate change while also complimenting the chair for choosing the most relevant topic in today’s scenario for the 11th ADMM-Plus Joint statement.

“Strengthening resilience to climate change in the defence domain requires multi-stakeholder engagement, from developing innovative solutions to managing the adverse impacts of climate change. This includes protecting vulnerable populations as well as safeguarding our defence installations,” the Defence Minister added. He also highlighted the need to deepen the understanding of the interlinkages between climate change and threats to security while calling for developing an ADMM-Plus Defence Strategy on climate change. Rajnath Singh also drew attention to the Global Commons – the shared natural resources and ecosystems essential to sustaining life and bringing prosperity on the planet.

He underscored the need to safeguard these Global Commons just and balanced by not resorting to unilateral actions. “These resources provide invaluable ecological, economic, and social benefits that extend beyond national boundaries,” said the Defence Minister. The 11th ADMM-Plus forum consisted of 10 ASEAN countries, eight Plus countries, and Timor Leste. Deputy Prime Minister and Defence Minister of Laos General Chansamone Chanyalath chaired the meeting.

BJP’s Sambit Patra Mocks Rahul Gandhi Over ‘India Hijacked’ Claims

BJP’s Sambit Patra Mocks Rahul Gandhi Over ‘India Hijacked’ Claims

BJP MP and spokesperson Sambit Patra on Thursday lashed out at the Leader of Opposition (LoP) in Lok Sabha, Rahul Gandhi, over holding a press conference with his version of ‘ek hain toh safe hain’ and also rebutted his ‘hijacking’ claims.

Patra, taking strong offence to Congress MP Gandhi for purported claims of ‘India has been hijacked’, mockingly said that his statement is correct, but he got the tense wrong. “India isn’t hijacked; it was already hijacked! The Gandhi family were the hijackers, and the commando (Modi Ji) freed it,” the BJP leader told media persons.

BJP spokesperson said that the Gandhi family and the Congress are unable to tolerate that India is continuously moving towards becoming the third largest economy of the world. Hence, they keep venting out their grudge.

“Since 2002, you, your mother and your party have been continuously trying to destroy the credibility of PM Modi. Today, the Prime Minister has been given the ‘Highest Civilian Award’ in another country, thousands of miles away. This is PM Modi’s credibility,” Patra said while adding that Rahul Gandhi and his mother, Sonia, are out of jail on bail.

Patra further accused the Congress MP and his ‘international structure’ of attacking the Indian market. BJP IT cell head Amit Malviya also took to X to share the growth data and Worker Population Ratio (WPR) to counter the Congress’ charge. “India has made significant progress on the employment front under the Modi government. They should take a hard look at their own performance during the UPA era,” Malviya said.

He further stated that Congress’s ecosystem’s baseless claims have crumbled in the face of data, as it shows the Modi government’s delivery of employment while exposing UPA’s disastrous track record. “It is time to remind the collective Opposition to look in the mirror before spreading misinformation,” he wrote on X.

Pashupati Kumar Paras Was Never Part Of NDA: Chirag Paswan

Pashupati Kumar Paras Was Never Part Of NDA: Chirag Paswan.

Union Minister Chirag Paswan has claimed that his uncle and former Union Minister Pashupati Kumar Paras was never part of the National Democratic Alliance (NDA). Chirag’s statement comes in response to Pashupati Kumar Paras’s announcement during a meeting of the Rashtriya Lok Janshakti Party (RLJP) in Patna, where Paras declared his intention to contest the 2025 Bihar assembly elections independently.

When questioned about Paras’s recent statements, Chirag clarified: “My uncle was never in the NDA alliance, neither during the Lok Sabha elections nor the Assembly elections. So, how can he talk about separation from an alliance he was never part of?” Pashupati Kumar Paras, who served as a Union Minister during the second tenure of Prime Minister Narendra Modi’s government, has maintained that RLJP is aligned with the NDA. However, the BJP did not allocate any seats to the RLJP during the 2024 Lok Sabha elections, Paras keeps saying that his party is part of the NDA. At the RLJP meeting in Patna, Paras was joined by key party leaders, including former Samastipur MP and Suraj Bhan Singh. Paras and his supporters resolved to strengthen the RLJP at the grassroots level ahead of the 2025 Bihar Assembly elections, declaring their intention to contest independently.

Shravan Aggarwal, a close associate of Paras, targeted Chirag Paswan during the meeting, asserting that Paras is the true successor of Ram Vilas Paswan, the founder of the Lok Janshakti Party (LJP). The feud between Chirag Paswan and Pashupati Kumar Paras has caused significant political rifts since the split of the Lok Janshakti Party (LJP) after Ram Vilas Paswan’s death. The LJP was divided into Lok Janshakti Party (Ram Vilas), led by Chirag Paswan and Rashtriya Lok Janshakti Party (RLJP), led by Pashupati Kumar Paras. Chirag has emerged as a prominent NDA ally, especially during the 2024 Lok Sabha elections, while Paras continues to assert his political presence independently.

This ongoing rivalry reflects the complexities of Bihar’s political landscape, especially within the Paswan family. Chirag Paswan, also expressed confidence in the Exit Polls for the Jharkhand and Maharashtra Assembly elections, stating that they accurately reflect the public’s mood. “The NDA family is growing under the leadership of Prime Minister Narendra Modi. I campaigned in Jharkhand and Maharashtra, and on November 20, the public voted overwhelmingly in favour of the NDA. We are on track to form governments in both states,” Paswan said.

When asked about Bihar Chief Minister Nitish Kumar distributing appointment letters to teachers and the RJD’s claim that they initiated employment initiatives, Chirag dismissed the opposition’s statements. “RJD leaders often make such claims. If they had any real strategy for providing employment, Lalu Yadav’s regime would not be remembered as Jungle Raj. During that time, Bihar saw the highest levels of migration. The people of Bihar are well aware of who can truly lead the state forward,” Paswan said.

People Want NDA To Win Maha And Jharkhand Polls, Claims HD Kumaraswamy

People Want NDA To Win Maha And Jharkhand Polls, Claims HD Kumaraswamy.

Union Minister for Heavy Industries and Steel H D Kumaraswamy claimed on Thursday that people want the NDA to win the Maharashtra and Jharkhand Assembly elections. Speaking to reporters in Bengaluru, Union Minister Kumaraswamy made the statement while reacting to the exit poll predictions giving edge to the BJP-led NDA alliance in Maharashtra and Jharkhand.

“The exit poll predictions are one aspect. It is the wish of people the NDA emerge victorious in both Maharashtra and Jharkhand,” he said. Regarding the Channapatna bypolls in Karnataka, he said, “I have actively participated in election campaigning for 15 days in the constituency. I know the feelings of the people. The NDA candidate is going to win.” Union Minister Kumaraswamy’s son Nikhil has contested as the NDA candidate from the Channapatna. Earlier, the seat was represented by HD Kumaraswamy. The Channapatna seat recorded 88.80 per cent voter turnout in the by-election. Congress nominee for Channapatna C. P. Yogeshwara said the state Tourism and Waqf Minister Zameer Ahmad Khan’s objectionable remarks against Union Minister Kumaraswamy have cost the party Vokaligga votes.

Commenting on the row over the cancellation of Below-Poverty-Line (BPL) ration cards in the state and Congress leaders referring to cancellations done by the Centre, HD Kumaraswamy said, “Why did not the Congress government say anything for a week?” He also attacked the Congress government in the state, saying, “The state government was not in a position to answer. The Chief Minister will issue one statement and the Food Minister will issue another.”

“There is no clarity among themselves. I won’t speak lightly about the guarantee schemes,” the Union Minister maintained.

Earlier in the day, Karnataka Food Minister K. H. Muniyappa said, “There is no clarity among themselves. I won’t speak lightly about the guarantee schemes,” the Union Minister maintained. The Minister also said that the cancellation of BPL cards was limited to government employees and people who pay income tax.

Kerala: Popsicle Vendor Rasheed Licks Each Treat Before Packaging, Shop Shut Down By Authorities After Video Goes Viral

Kerala: Popsicle Vendor Rasheed Licks Each Treat Before Packaging, Shop Shut Down By Authorities After Video Goes Viral

Authorities in Kozhikode have taken swift action against a popsicle shop after a video showing the maker’s unhygienic practices went viral. The incident occurred at “Ice Me,” a shop located in Elettil Vattoli within Kizhakkothu panchayat near Koduvally.

The video, captured by a customer, showed Rasheed, the popsicle maker from Ambalapparambil in Choolam Vayal, Kunnamangalam, tasting each popsicle before packing it. Public outrage over the video prompted an immediate response from the food safety and health departments.

The Koduvally police, alerted to the issue, locked the premises and referred the matter to relevant authorities. Food Safety Officer Anees Rehman and Junior Health Inspector PM Vinod conducted an inspection of the shop. During their visit, they collected samples of the flavored ice for testing at the Regional Analytical Laboratory in Malapparamba, Kozhikode.

“The shop’s registration has been suspended, and a report has been submitted to the Assistant Food Safety Commissioner for further action,” said Rehman. He added that the shop operator claimed the popsicles were not for sale but intended for personal consumption by his family, as the machinery had been idle for months. However, the inspection revealed the premises were unhygienic, leading to its closure.

Junior Health Inspector Vinod noted that both the ice-making unit and its retail outlet had been non-operational for several months. “The reason behind the maker’s actions remains unclear,” he said.

Authorities are awaiting the results of the laboratory analysis to determine the next course of action against the shop and its operator. The incident has raised concerns about hygiene standards in small-scale food production units.

TN BJP State Secretary SG Suryah Criticizes DMK & Congress For Failing Velachery Residents, Questions Congress MLA Aassan Maulaana’s Effectiveness

Tamil Nadu BJP state secretary SG Suryah has criticized the ruling DMK government for betraying Velachery residents and questioned the effectiveness of DMK ally Congress MLA Velachery JMH Aassan Maulaana in assisting the people. He condemned the government’s actions, particularly a biometric survey that may lead to possible eviction of families along the Velachery lake bed without prior warning. Suryah accused the DMK and the Congress MLA of causing residents to live in constant fear, whether from rain or government actions.

On 20 November 2024, SG Suryah took to his official X account to express his concerns for Velachery residents, stating, “Should Aassan Maulaana of the Congress Party, who is unfit to help the people of #Velacherry, continue as an MLA in the coalition DMK regime? The fake Dravidian model DMK government has initiated a biometric survey to evict over a thousand families living along the Velachery lake bed without prior warning. People of Velachery are also protesting against this. Either the rains are keeping residents of Velachery in panic or this government is keeping them in panic. When Mr. Aassan Maulaana, the Congress MLA and the ally of the ruling DMK government, visited the area, people imprisoned him and appealed. It appears the officials have now left, But will these people have to live in panic every day?”

“Is the puppet Chief Minister, Mr. M.K. Stalin, refusing to listen to the pleas of his own alliance partner, the Congress MLA? Is it not a shame that Congress MLAs, part of the ruling alliance, cannot do anything for the people they represent?” He questioned.

The recent condemnation follows the action taken by the Water Resources Department (WRD) on 18 November 2024, which initiated a biometric survey as the first step in removing encroachments on the Velachery lake in compliance with a directive from the National Green Tribunal. According to WRD Assistant Engineer Mahendra Kumar, 203 houses were surveyed along the 100-ft Velachery Bypass Road. He explained that the full scope of encroachments would be revealed through the survey. After gathering the necessary data, the department would coordinate with the Tamil Nadu Urban Habitat Development Board (TNUHDB) to provide alternative housing for affected residents. The department plans to demolish the structures soon. Officials estimate that approximately 2,000 legal and illegal encroachments—including huts, shanties, marriage halls, residential homes, and government buildings—have reduced the lake’s area from 265 acres to just 55 acres.

The WRD aims to reclaim around 20-30 acres of the lake by removing all encroachments and restoring it at an estimated cost of ₹23 crore, which would include strengthening the bunds and plugging sewage outfalls. The lake receives water from the Raj Bhavan Canal and a 600-acre catchment area spanning Guindy, Adambakkam, Maduvinkarai, and Kannigapuram, in addition to rainfall. “If the lake were restored to its original capacity, it could accommodate all the water from its catchment area. Now, due to encroachment, Velachery is sinking,” said S. Kumararaja of the Federation of Velachery Welfare Associations.

The lake’s 2.14 km surplus channel, running along the 100-ft road, eventually joins the Pallikaranai marsh and the 3.3-km-long Veerangal Odai at a common outfall near the Kaiveli bus stop. Residents are urging the Greater Chennai Corporation (GCC) and the Highways Department to disconnect the confluence of these two channels at the outfalls and create a separate outfall for the lake’s surplus water. Due to inadequate carrying capacity, neighborhoods along the Odai, such as AGS Colony, and areas along the lake’s surplus channel, including Dhandeeshwaram Nagar, are experiencing frequent flooding. Additionally, residents are calling for restoring the Taramani Link Road-Buckingham Canal channel and a six-vent culvert beneath the Velachery-Perungudi Station Road. “There’s a micro-canal beneath the Taramani Link Road-Thiruvanmiyur stretch,” noted M. Balakrishnan of the Tansi Nagar Residents’ Welfare Association (RWA). The six-vent culvert, which was meant to be 70 feet wide beneath the MRTS station, needs to be cleared to prevent flooding in 10 key locations. Residents argue that the WRD should remove all encroachments without discrimination, ensuring fair treatment for all affected.

In response to the WRD’s actions, local residents staged protests when Hassan Maulaana, the Congress MLA for the area, visited the site.

EPS Slams DMK Govt For Inaction On YouTuber Irfan Who Published Video Of Himself Cutting His Newborn’s Umblical Cord

The Leader of the Opposition and AIADMK General Secretary, Edappadi K. Palaniswami, has criticized the ruling DMK government for allegedly showing favoritism towards controversial Tamil YouTuber and influencer Mohammed Irfan. Irfan recently posted a video of himself cutting the umbilical cord of his newborn baby in an operating theater on his YouTube channel. This act, which is a clear violation of the law, has gone unpunished, with the only response from the authorities being a show-cause notice. Palaniswami has called this lack of action a serious lapse in governance.

In a condemnation letter issued on 20 November 2024, highlighting several instances of negligence in medical procedures that have led to the deaths of poor citizens, Edappadi K. Palaniswami expressed strong disapproval. He stated, “I condemn the inaction of the Health and Family Welfare Department under the DMK Government, which continues to be embroiled in various controversies.”

In his statement, Edappadi K. Palaniswami highlighted several disturbing incidents of medical negligence under the current DMK government. He detailed cases such as that of a football player who came in for knee surgery at Periyar Nagar Hospital, only to lose her leg and life due to incorrect treatment. He also spoke of a 7-year-old girl, the daughter of a head constable from Otteri police station, who received improper treatment at Egmore Children’s Hospital, leaving her right leg crippled. Additionally, he mentioned a girl at Cuddalore Government Hospital who, after seeking treatment for a cold, was mistakenly given a dog bite injection.

Palaniswami also brought attention to the shocking case of a child’s body being kept in a sack after death at a government hospital just a few days ago. Another incident involved a patient’s assistant assaulting a doctor at Guindy Hospital last week, sparking a protest demanding better protection for doctors and healthcare staff. Furthermore, he noted the tragic death of a patient named Vignesh, who passed away due to a lack of proper treatment.

As Leader of the Opposition, Palaniswami emphasized that since the DMK took office in 2021, he has repeatedly raised these concerning issues with the government. However, instead of addressing these problems, Health Minister M. Subramanian has only offered contradictory responses, failing to take effective action.

Then taking a jibe at the DMK Health minister Ma. Subramanian stated, “Minister of Health and family welfare who initially moved heaven and earth stating that, “I will take appropriate action against the YouTuber who acted illegally and cut the baby’s umbilical cord,” has sneaked in questioning the journalists if this was a crime of murder, as soon as the footage of the person sitting and eating with the Scion minister Udhayanidhi appeared on social media, has caused great dissatisfaction among the public. It is an incomprehensible mystery that this government has not taken any action even after this YouTuber Irfan revealed the gender of the child.”

Background

Tamil YouTuber Mohamed Irfan, known for frequently flouting state laws, seems to have once again escaped accountability, raising concerns about the DMK government’s leniency towards him. This troubling display sets a dangerous precedent.

The incident in question occurred when Irfan posted a video on his YouTube channel, “Irfan’s View”, filmed at a private hospital in Chennai. The video depicted Irfan cutting his newborn’s umbilical cord on camera as he and his wife, Aaliya, celebrated the birth of their first child.

Despite DMK Health Minister Ma. Subramanian’s statement over two weeks ago, vowing severe action against Irfan once he returned from abroad, no significant steps have been taken against him. Instead, the hospital involved has been penalized, but Irfan himself has faced no consequences for his actions, leading to criticism of the government’s inaction and perceived special treatment.

So far, YouTuber Irfan, sent a letter to the Health Department, expressing his respect for Tamil Nadu’s health authorities and clarifying that he never intended to cause harm. Irfan, claiming he was currently abroad, apologized for any misunderstandings and stressed that he had no intention of violating medical ethics.

However, the Health Department took immediate action against the hospital. The hospital where the procedure took place was fined ₹50,000 and its operations were suspended for ten days. Additionally, the Directorate of Medical and Rural Health Services (DMS) revoked the Clinical Establishment Act registration of Rainbow Children’s Hospital in Sholinganallur, suspending all patient care activities for ten days, starting October 24.

An exception was made for pregnant women receiving continuous treatment at the hospital. Rajamoorthy, the Director of Medical and Rural Health Services, explained that the registration was withdrawn under Section 5 (2) of the Tamil Nadu Private Clinical Establishments (Regulation) Act. The State Rural Health Department has also filed a police complaint against Niveditha, the gynaecologist at the Chennai private hospital and Irfan. Reports emerged on 5 November 2024 that she’s also been served notice by the Tamil Nadu Medical Council .

Health Minister Ma. Subramanian’s recent statement, dismissing the act as “not a murderous crime,” stands in stark contrast to his earlier comments on 22 October 2024, when he had vowed that severe actions would be taken. This shift in stance suggests that, once again, the DMK government may not pursue serious consequences. As a result, Youtuber Irfan is likely to continue posting vlogs and videos—perhaps even with Dravidian Stocks—on his channel without facing any significant repercussions for his violation of the law.

It is noteworthy that Irfan had previously faced controversy after disclosing the sex of his unborn child, following a prenatal test conducted abroad. Revealing the sex of a fetus is a violation of the Pre-Conception and Pre-Natal Diagnostic Techniques Act.

The ruling DMK, known for strictly enforcing laws against its critics, has recently faced backlash over its approach to handling YouTuber and food vlogger Mohamed Irfan. Although the party has previously arrested citizens for legal infractions, it seems to be treating Irfan differently by issuing him a show cause notice, requesting an explanation for a controversial video he posted.

Observers and political analysts suggest that influencers like Mohamed Irfan have previously helped promote DMK’s ideology within the state, particularly during election run-up.

It is noteworthy that Irfan shares a close relationship with the DMK scion. He did a public relations video with DMK scion and Minister Udhayanidhi Stalin in November 2022. In the video Irfan asks Udhayanidhi Stalin “You’ve become my friend now right? You’re my friend right? Give your hand bro. (shakes hand). From now on, we’re friends. Like in the film OKOK (Oru Kal Oru Kannadi starring Udhayanidhi Stalin), if I get caught by police and call you, will you help me?

This is seen as the reason why the DMK may be hesitant to take stricter action against him.

The Adani Indictment And The DMK Government

The Adani Indictment And The DMK Government.

The indictment of Gautam Adani in a US court over a bribery scheme involving $250 million in payouts to Indian state officials sent shockwaves across India. Tamil Nadu, governed by the DMK, has found itself at the centre of the controversy, with questions mounting over its long-term power purchase agreements and alleged involvement in the Adani bribery scandal.

Bribery Allegations And SECI Power Agreements

Between July 2021 and February 2022, state-run electricity distribution companies (DISCOMs) in Tamil Nadu, Andhra Pradesh, Odisha, Chhattisgarh, Jammu & Kashmir, and others entered into Power Sale Agreements (PSAs) with the Solar Energy Corporation of India (SECI). Tamil Nadu Generation and Distribution Corporation Limited (TANGEDCO) was among these entities, allegedly entering into a PSA under the Manufacturing Linked Project.

The indictment details how bribes, calculated at ₹25 lakh per megawatt, were paid or promised to state officials to secure these agreements. In Andhra Pradesh, where the largest deal of 7,000 MW was struck, the total bribe amounted to ₹1,750 crore (more than $200 million). Tamil Nadu’s agreement, though not quantified in the indictment, has also come under scrutiny.

Tamil Nadu’s 25-Year Power Purchase Agreement

The DMK government in Tamil Nadu signed a 25-year power purchase agreement with SECI in May 2024. Critics question why such a long-term commitment was made when the government’s remaining tenure is just two years.

Further complicating matters is the timeline of the bribery scheme. According to the indictment, state governments allegedly rejected SECI’s initial Letters of Award due to high tariffs, but this resistance was eventually overcome through massive payouts.

Central Government’s Rejection

SECI’s tentative acceptance of power tariffs from Adani Green and Azure hit a roadblock when state governments refused to accept the terms, citing unfeasible economics. However, the indictment alleges that Gautam Adani and Sagar Adani personally intervened, offering bribes to state officials to move the agreements forward. This ensured SECI could finalize contracts with the states, including Tamil Nadu.

Political Accusations And DMK’s Role

The BJP has leveraged the indictment to target the DMK government, raising questions about its involvement. Specifically, Chief Minister M.K. Stalin’s alleged meeting with Gautam Adani at his Chittaranjan Road residence has been scrutinised. Critics demand clarity on whether the meeting pertained to bribery, investment proposals, or money laundering.

Additionally, opposition leaders have called for a detailed explanation from Stalin on the following:

  1. The terms of Tamil Nadu’s power purchase agreement with SECI.
  2. The role of TANGEDCO officials in facilitating this deal.
  3. The alleged bribes received by Tamil Nadu officials during the 2021–2022 period.

Documents And Evidence

The indictment includes contemporaneous records maintained by Adani Green, listing specific states, corresponding power purchase amounts, and associated bribe payouts. Tamil Nadu is explicitly named in these records, along with Odisha, Chhattisgarh, Andhra Pradesh, and others.

UNI earlier reported about Gautam Adani’s meeting with Stalin. This meeting raises suspicions of deeper involvement, fueling the demand for an independent investigation.

The fallout from the indictment isn’t limited to Tamil Nadu. Other states governed by the Congress (Chhattisgarh), Biju Janata Dal (Odisha), and YSR Congress (Andhra Pradesh) are also implicated. However, Tamil Nadu’s position as a DMK-governed state, coupled with its long-term PPA in 2024, has intensified the political scrutiny.

Amidst the uproar, demands for transparency have grown louder. Critics argue that the DMK government must:

  • Disclose the specifics of its PSA with SECI, including terms, tariffs, and decision-making processes.
  • Address allegations of bribes promised or paid during the power purchase deal.

The BJP has amplified these calls through a targeted social media campaign, labeling the DMK government as complicit in Adani’s bribery scheme.

The Adani bribery scandal has cast a shadow over DMK governance, raising questions about their role in the unfolding drama. As demands for accountability mount, the DMK leadership faces pressure to explain transparently its dealings with SECI and Adani. Whether these allegations will lead to legal or political consequences remains to be seen.
