“Language Of FIR Shocking, It Is Victim Blaming, Police Failed To Keep History-Sheeter Accused Under Surveillance”: Madras High Court Slams DMK Govt Over Anna University Sexual Assault Case, Constitutes SIT And Orders ₹25 Lakh Compensation Along With Free Education To Victim

The Madras High Court directed the formation of an all-women SIT to investigate the sexual assault case at Anna University

The Madras High Court, in a strongly worded order, has directed the formation of an all-women Special Investigation Team (SIT) to investigate the sexual assault case at Anna University. The SIT, comprising senior IPS officers Bhukya Sneha Priya, Ayaman Jamal, and S. Brinda, has been tasked with taking the matter up “in right earnest” and filing chargesheets in both criminal cases registered in connection with the incident.

The court expressed grave concern over the leak of the FIR in the Anna University sexual assault case, calling it a “serious lapse” in the investigation. In a scathing order, the court criticized systemic failures and emphasized the need for justice, dignity, and accountability in addressing crimes against women.

Recognizing the lapses by the police, including the leak of the victim’s FIR, the court ordered the state to provide interim compensation of ₹25 lakh to the victim. The amount is meant to address the trauma caused to her and her family and the systemic failures in protecting her dignity. The court also directed authorities to provide interim protection to the victim and her family, ensuring their safety during the investigation.

The court reiterated that the victim must be allowed to complete her education at Anna University without being charged any fees. The university administration was also instructed to strengthen its Internal Complaints Committee (ICC) by appointing efficient personnel to prevent such incidents in the future.

The Director General of Police (DGP) has been ordered to provide full support to the SIT in its investigation. The court expressed hope that the all-women SIT would conduct a thorough and impartial investigation, emphasizing the importance of filing chargesheets promptly to ensure justice.

The court also censured the press conference held by the Chennai Police Commissioner, which revealed details of the investigation at an early stage. The bench directed the state government to examine whether this violated service rules and take appropriate action, if necessary.

The bench criticized the police for not keeping the accused, a history-sheeter, under surveillance. It also called out the “misogynistic and deplorable” language of the FIR, which it said paved the way for victim-blaming. The court noted that the FIR breached the victim’s dignity and bodily autonomy, intensifying her trauma and causing mental agony.

In a powerful statement, the court urged society to shed patriarchal biases. “Why can’t a woman walk alone freely, dress as she wishes, or speak to a man without being judged? It was never her fault, but society’s for judging her,” the court observed. It emphasized the need for systemic changes to ensure women’s safety and dignity.

Anna University Sexual Assault Case: Madras High Court Slams Police For FIR That Reads Like Victim Blaming, DMK Govt Counsel Blames Citizens & Media For Accessing FIR

Madras High Court Slams TN Police For Leaking FIR Copy Containing Sensitive Details Of Anna University Sexual Assault Case

The Madras High Court, in a rare Saturday sitting, witnessed a charged hearing on the handling of the Anna University sexual assault case. Advocate General (AG) P.S. Raman informed the court that the First Information Report (FIR) in the case had been downloaded by 14 individuals before being blocked. He attributed the delay in blocking the FIR to a technical transition from the Indian Penal Code (IPC) to the Bharatiya Nyaya Sanhita (BNS). The AG assured the court that cybercrime authorities are investigating the leak.

Justice Lakshminarayanan questioned how many FIRs related to crimes against women and children had been leaked due to similar glitches since BNS’s implementation on July 1, 2024. The AG maintained that the police had no role in the leak but criticized the media for accessing and publishing the FIR, which included sensitive details about the victim. He warned that the role of media personnel would also be scrutinized during the investigation.

The bench, comprising Justices Lakshminarayanan and Subramaniam, strongly criticized the language of the FIR, labeling it as victim-blaming. Justice Lakshminarayanan remarked, “Have you read the FIR? It is an example of victim blaming. The victim is a student..only 19 years old. Isn’t it the SHO’s duty to assist the victim in registering the FIR, in wording it. It reads like something that we would read in secret in the boys’ hostel. Your police needs to be sensitised. You were dressed in a way to invite the assault. This is what the FIR reads like”.

Justice Subramaniam emphasized that police personnel should have assisted the victim in framing the FIR in a manner that could withstand judicial scrutiny.

Addressing public concerns, the AG defended the Chennai Police Commissioner’s press briefing on the case. He argued that the commissioner acted within the law and carefully stated that “as per the investigation conducted so far, there is only one accused.” Justice Subramaniam questioned why similar briefings were not held for other criminal cases, suggesting an inquiry into the All India Service Rules.

The court also delved into campus security lapses, with Additional Advocate General (AAG) J. Ravindran representing Anna University. The AAG described the university’s safety measures and confirmed that the victim would be allowed to continue her studies. When asked about allegations of systemic sexual harassment on campus, he acknowledged the university’s commitment to investigating such claims and implementing stricter safety protocols.

The role of the media remained a contentious topic. DMK government’s counsel Raman said “The police and the State know their responsibility to keep the victim’s details safe. But the citizens and the media too have such responsibility. Just because they came across her details, they needn’t have posted and shared it.

Justice Subramaniam underscored the importance of press freedom, stating, “It is because of the press that many wrong actions are brought to light.

The court concluded by urging both the police and the university to ensure justice for the victim while addressing broader systemic issues, emphasizing the need for institutional accountability and media responsibility.

“Councilors Are Not Kings Of Their Areas”: Vanathi Srinivasan Explains How DMK Councilors Are Stopping Welfare Schemes And Initiatives In Coimbatore, Urges Action On Paralympic Sports Center Delay

Vanathi Srinivasan Explains How DMK Councilors Are Stopping Welfare Schemes

Coimbatore South MLA and BJP Mahila Morcha President Vanathi Srinivasan has strongly criticized DMK councilors, accusing them of behaving like satraps in their respective wards. She alleged that when a legislator proposes a project and secures a budget for it, the corporation councilors obstruct its implementation. Furthermore, she claimed that even when such incidents are reported to corporation officials, no action is taken, as the officials appear to be colluding with the councilors.

Vanathi Srinivasan leveled these accusations during a program organized by the Coimbatore People’s Service Center to distribute free sewing machines to 50 underprivileged women. The event took place today at Sivananda Colony’s Hosimin Nagar, where Vanathi Srinivasan personally distributed the sewing machines to the beneficiaries.

Following the event, while addressing a press meet, Vanathi Srinivasan stated, “If an MLA proposes a project or constructing a bus stand using MLA funds, local councilors in the area act as though they are kings of their area and obstruct the implementation of work there. The corporation officials are indifferent, simply answering us by consulting with them and respond to us what they say. Let me give you an example. In Ramanathapuram, there was an issue regarding the placement of a water tank and a water ATM. To avoid conflicts with them, what did I do? 300 families in the area signed a petition and submitted it to me. I forwarded that to the corporation commissioner, highlighting the collective demand of these 300 families that they want it there. Yet, the response I received was ‘compromise with the councilors.’ Why should there be a need for reconciliation? If an MLA initiates a project based on the people’s requirements, why must it hinge on the councilors’ approval? What’s happening here? Ward councilors doesn’t mean they are kings of that area. They are attempting to block MLA-funded works. For instance, I allocated funds for a bus stand after local authorities identified and approved the site. The corporation finalized the contractor and began the work, but local councilors intervened and stopped the project, claiming they had assigned the project to another contractor two years ago. When I brought this to the corporation’s attention, there was no response. They are not even allowing us to work.”

Criticizing the DMK administration, Vanathi Srinivasan highlighted her efforts to support para-athletes in her constituency. She stated that six months ago, she had sanctioned a ₹2 crore fund and issued the necessary approval to build a gymnasium for para-athletes, leveraging her role as the All India Chief Patron of the Paralympic Committee. The initiative aimed to provide a dedicated training facility for these athletes.

However, despite her efforts, progress has been stalled. She explained that the authorities had not even identified a suitable location for the project. “I have approached the district collector four times and spoke to corporation commissioner multiple times,” she noted. When an area was finally proposed, the sports department deemed it insufficient for constructing the center. Highlighting the challenges, she described the situation as indicative of broader inefficiencies within the state.

Vanathi Srinivasan concluded by urging the state government to prioritize this issue and allocate adequate land for establishing the Paralympic sports center, emphasizing its importance for the welfare and development of para-athletes.

Madras High Court Rules Service Registers Of Public Servants Not Fully Exempt From RTI Disclosure

Madras High Court Rules Service Registers Of Public Servants Not Fully Exempt From RTI Disclosure ias officers kanavu illam

In a significant ruling, the Madras High Court has clarified that the service register of a public servant cannot be entirely exempted from disclosure under Section 8 of the Right to Information (RTI) Act. Justice C.V. Karthikeyan emphasized that while Section 8(j) of the Act protects personal information from disclosure, certain details in the service register, such as assets and liabilities, do not fall under the category of private information and are subject to public scrutiny.

The court acknowledged the importance of transparency in public service, stating that details such as the date of joining, promotions, and nature of work performed by a public servant are not sensitive and can be disclosed. However, the court stressed the need for reasonable restrictions to protect the career and integrity of the individual.

It is undeniable that the assets and liabilities of a public servant must be disclosed and cannot be shielded from public scrutiny. However, reasonable restrictions should be imposed. Information that does not harm the career of the public servant, such as the date of joining, promotions, and the nature of work, may be disclosed,” Justice Karthikeyan remarked.

The court also instructed that any denial of information must be accompanied by a clear rationale. Officials responsible for handling RTI requests must scrutinize the service register materials and assess the necessity of the requested information before making a decision.

The judgment came in response to a petition filed by M. Tamilselvan, who had challenged a decision by the Revenue Divisional Officer, North Madras, refusing to provide certain information about public servants. Tamilselvan had sought details regarding the disproportionate wealth of an Assistant Engineer in the Water Reservoir Project Sub-Division in Krishnagiri Taluk and the service register of a Panchayat Secretary.

The Revenue Divisional Officer had denied the request, citing Section 8 of the RTI Act as a basis for exemption. However, the court deemed this explanation insufficient, asserting that once an individual enters public service, they are subject to public scrutiny and cannot completely withhold details about their service.

In its ruling, the court remanded the matter to the District Collector for reconsideration and directed the appeal to be resolved within two months, following the legal procedures outlined.

This decision underscores the balance between transparency and privacy in public administration while reaffirming the right of citizens to access critical information about those in public service.

Tenkasi Police Constable Resigns After Death Threats, Alleges Senior Officials’ Collusion With Sand Mafia

In a dramatic turn of events, a police officer in Tenkasi, Tamil Nadu, has tendered his resignation, citing death threats after taking action against illegal sand smugglers. The officer, Prabhakaran, a Grade 1 police constable stationed at the Sivagiri Police Station, also accused senior officials, including the Deputy Superintendent of Police (DSP), of collusion with the sand mafia.

On 18 December, while patrolling, Prabhakaran stopped a vehicle transporting sand without proper documentation and confiscated it. He repeated similar actions with two other vehicles the same day. However, his efforts were met with severe backlash.

According to Prabhakaran, three individuals threatened his life, obstructed his work, and forcibly took back the seized vehicles. The officer claimed that despite notifying his superiors, no concrete actions were taken to address the threats or protect him.

In his resignation letter, Prabhakaran alleged that certain senior officers, including the Puliyangudi DSP, were complicit in the illegal sand smuggling activities. He presented evidence, including video and audio recordings, to substantiate his claims of corruption and negligence by high-ranking officials. He also accused Assistant Inspector Varadharajan and other officials of tampering with seized evidence, such as preparing fake passes for impounded vehicles and returning them to the sand mafia.

The officer highlighted systemic issues plaguing the police force, stating that unethical practices and corruption by senior officials have tarnished the reputation of the police. He cited alarming statistics of police suicides and deaths over the past few years, attributing them to workplace stress and harassment.

Prabhakaran further expressed fears for his safety, alleging that his phone and location were being illegally monitored by certain officials. He called for action against those involved in cybercrimes and the sand mafia’s illegal activities, which he claimed had caused significant losses to the government.

The resignation letter, now widely circulated on social media, has sparked outrage and drawn attention to the allegations. Senior police officials have reportedly initiated an inquiry, summoning the constable and DSP to investigate the claims.

Prabhakaran’s statement included a plea for action against the sand smuggling mafia and the officials complicit in enabling their operations. He also submitted extensive evidence, including audio, video, and photographs, to support his allegations.

The incident has stirred public debate, with many calling for a thorough investigation into the alleged corruption and threats faced by the officer. Senior officials are under scrutiny, and the case has raised serious questions about the integrity and safety of law enforcement personnel working against organized crime. As the investigation unfolds, the situation underscores the pressing need to address systemic corruption and ensure the protection of officers committed to their duty.

Madras High Court Slams TN Police For Leaking FIR Copy Containing Sensitive Details Of Anna University Sexual Assault Case

Madras High Court Slams TN Police For Leaking FIR Copy Containing Sensitive Details Of Anna University Sexual Assault Case

The Madras High Court on Friday strongly criticized the Tamil Nadu Police for disclosing the identity of a 19-year-old student who was sexually assaulted on the Anna University campus earlier this week.

According to a report by Bar & Bench, the Vacation Bench comprising Justice SM Subramaniam and Justice V Lakshminarayan questioned how the police allowed the First Information Report (FIR) to be leaked and expressed concern over the impact on the victim’s family. The Court remarked, “Who will take responsibility for the suffering inflicted on the victim’s family?

The judges emphasized that such lapses could deter others from seeking police help in similar situations. “Parents of students will now hesitate to approach the authorities. This incident may discourage victims from coming forward,” the Court stated, urging students to share any additional information they may have about the case.

The Bench reprimanded the police for failing to redact identity details in the FIR and demanded an explanation by the following morning, stating that the damage to the victim’s family could not be undone. The hearing was adjourned to Saturday.

The case is being examined following multiple petitions, including one filed by advocate Jayaprakash, a member of the AIADMK, who sought a thorough investigation. Earlier in the day, the Court directed the Tamil Nadu government to submit a status report on the case by the afternoon.

On December 25, Chennai Police arrested Gnanasekaran, a biryani vendor, for allegedly assaulting the student on campus. The incident reportedly occurred on December 23, with the victim filing complaints with both the police and Anna University’s Internal Complaints Committee.

The Court questioned the Commissioner of Police’s premature declaration that only one individual was involved in the crime, despite an ongoing investigation. “How could the Commissioner hold a press conference and make such a statement? What do service rules say about publicizing ongoing investigations?” it asked.

The Bench also raised concerns about allegations of custodial torture, questioning why the accused was seen with injuries. The State explained that the injuries occurred during an attempted escape.

Pointing to potential lapses by Anna University, the Court criticized the institution for allowing such an incident to occur on its premises. It also noted the university’s reluctance to cooperate fully with the police investigation.

Jayaprakash argued that the accused, who had a history of criminal activity, was inadequately monitored by the police. He also condemned the police for leaking the victim’s personal information, exposing her and her family to further distress. He requested a Special Investigation Team (SIT) led by a judge, though the Court stated that judges are not equipped to lead investigations.

Another petitioner, advocate GS Mani, alleged that the accused had been subjected to police brutality, possibly to shield others involved in the case. He also highlighted the accused’s extensive criminal record, with 20 cases registered and 16 convictions. Mani further revealed that out of 70 CCTV cameras on the university campus, only 14 were functional.

In response, Advocate General PS Raman defended the State, dismissing claims of political connections to the accused and noting that the crimes were committed during the AIADMK’s tenure. He also argued that the accused was arrested within 24 hours, urging recognition of the police’s swift action. However, the Court rejected this, stating that crime prevention is the State’s constitutional duty, and arrests after a crime do not warrant praise.

The Court also highlighted the growing drug problem as a contributing factor to such crimes and urged the State to take preventive measures. Additionally, it cautioned against attributing the incident to women’s behavior or freedoms, affirming that such narratives should not emerge.

The hearing continues as the Court seeks further accountability and action from both the State and Anna University.

“Removing Temple Was Not Appropriate”: MP High Court Bar Association Challenges Hanuman Temple Removal At Chief Justice’s Residence

MP High Court Bar Association Challenges Hanuman Temple Removal At Chief Justice's Residence

The Madhya Pradesh High Court Bar Association has raised objections to the removal of a Hanuman Temple situated on the premises of Chief Justice Suresh Kumar Kait’s official residence. The association has appealed to Chief Justice of India (CJI) Sanjiv Khanna for an investigation and appropriate action regarding the matter.

According to the letter submitted to the CJI, the temple, located within the Chief Justice’s bungalow, holds historical significance. Several former Chief Justices, including Justices SA Bobde, AM Khanwilkar, and Hemant Gupta—who were later elevated to the Supreme Court—are said to have worshipped there. Employees at the residence also reportedly performed regular puja at the temple.

Even Muslim Chief Justices who previously occupied the bungalow, such as Justices Rafat Alam and Rafiq Ahmed, did not raise objections to the temple’s presence. The association noted that the bungalow and the temple are government properties, and the temple’s reconstruction over the years has been funded by the government. The bar body emphasized that the temple facilitated convenient worship for those practicing Sanatan Dharma, making life peaceful and harmonious for its residents.

Objections To Demolition

The association argued that the temple could not have been removed without proper governmental approval or a statutory order. It described the removal as disrespectful to followers of Sanatan Dharma.

The controversy intensified after a lawyer, Advocate Ravindra Nath Tripathi, submitted a complaint to the President, Prime Minister, CJI, and Union Law Minister, accusing Chief Justice Kait of demolishing the temple, which had existed for a long time. The complaint highlighted that the bungalow is not personal property and such actions were inappropriate.

Related Developments

The incident has reportedly inspired another lawyer to file a public interest litigation (PIL) seeking the removal of all temples from police stations across the state. Concerns have been raised that Justice Kait might support such actions. Advocate Tripathi has requested a formal inquiry, criminal proceedings, and the transfer of the Chief Justice. He has also urged Justice Kait to recuse himself from hearing the PIL regarding temple removals.

Statements From Bar Association President

Dhanya Kumar Jain, President of the Madhya Pradesh High Court Bar Association, confirmed that the temple was removed during Justice Kait’s tenure, although earlier Chief Justices had allowed its existence. Jain speculated that Justice Kait’s Buddhist beliefs might have influenced his decision.

“This is an official residence. Such matters should be investigated. While we respect the judge’s adherence to Buddhism, removing a temple is not appropriate if this indeed occurred,” Jain remarked.

The incident has sparked significant debate, with many demanding accountability and calling for respect towards religious sentiments.

Ziaul Huq Assaults Ayyappa Devotee, Tears Mala And Shirt In Andhra Pradesh, Made To Apologise By Police

Ziaul Huq Assaults Ayyappa Devotee, Tears Mala And Shirt In Andhra Pradesh, Made To Apologise By Police

Tension flared in Madanapalle, Annamayya district of Andhra Pradesh after an Ayyappa devotee was allegedly assaulted by a Muslim youth named Ziaul Huq. According to locals, the devotee, identified as Venkatesh, was targeted by Huq for wearing an Ayyappa mala.

The altercation occurred near the RTC bus stand on the evening of 25 December 2024, when Venkatesh reportedly asked Huq to move his two-wheeler that was obstructing the road. Enraged by the request, Huq allegedly attacked Venkatesh, tearing his Ayyappa mala and shirt during the assault. As the situation escalated, locals gathered at the scene and intervened.

The incident quickly drew attention from Hindu groups, who arrived at the location and condemned the attack, chanting slogans in support of Lord Ayyappa. The groups demanded stringent action against Ziaul Huq, a native of Bidar, for disrespecting the religious symbol associated with Lord Ayyappa.

Police arrived at the scene to restore order and detained Ziaul Huq. To pacify the angry devotees, Ziaul apologised by touching Venkatesh’s feet, an act witnessed by several other Ayyappa devotees. The situation was eventually brought under control.

This incident follows another attack earlier in December, where a group of Muslims attacked a bus carrying Ayyappa devotees in Rayachoti town. The mob objected to the loud volume of Hindu devotional songs being played on the bus, claiming the music was audible from outside the vehicle.
