sonia rahul gandhi national herald congress india

The National Herald case is back on the front-page news as the Delhi High Court on Monday (22 February) sought the response of Congress chief Sonia Gandhi and her son Rahul Gandhi on a plea by BJP MP Subramanian Swamy seeking to lead evidence in the matter before the trial court.

Justice Suresh Kait, while issuing notice to the Gandhis, AICC general secretary Oscar Fernandes, Suman Dubey, Sam Pitroda and Young India (YI), sought their stand on Swamy’s plea by April 12.

Satya Sabharwal appeared as counsel for Swami, and advocate Tarannum Cheema, for the Gandhis and others. Both confirmed that the high court has issued a notice in the matter and stayed the trial court proceedings till 12 April.

Subramanian Swamy had filed a private criminal complaint in the trial court, accusing the Gandhis and others of conspiring to cheat and misappropriate funds.

According to Swami, Young Indian Pvt Ltd had ― by paying only ₹50 lakh ― obtained the right to recover ₹90.25 crore that Associate Journals Ltd, the owner of English daily National Herald, owed to Congress.

All the seven accused ― the Gandhis, AICC treasurer Motilal Vora, AICC general secretary Oscar Fernandes, Suman Dubey, Sam Pitroda and YI ― have denied the allegations.

It must be noted that the senior Congress leader Motilal Vora passed away a while back.

Women in Saudi Arabia can now serve in the military

In a quest to modernise and reform Saudi Arabia, the home to the world’s two holiest Mosques will now allow women to serve in the military.

The Kingdom of Saudi Arabia (KSA) under the leadership of Crown Prince Mohammad Bin Salman will now allow women to serve in the military establishment in several roles like soldiers, lance corporals, corporals, sergeants and staff sergeants, reports Economic Times.

This plan, first announced in 2019, will allow women to serve the nation’s military if they fulfil the usual weight and height criteria and the minimum qualification of high school education. However, applicants married to foreigners would continue to be barred from joining the service.

In the bid to modernise this oil-rich nation, last year, KSA’s Minister of Justice had also appointed 100 women as public notaries and had added that the Islamic Kingdom would soon begin to appoint women as court judges.

One of the major developments in this Sharia-compliant nation was when women were allowed to drive and leave the country without requiring permission from a male relative, ending a restrictive guardianship system.

Saudi Arabia has realised that the world is slowly moving away from fossil fuel and it can no longer rely on just selling petroleum, which is why Bin Salman is introducing several reforms to transform the Arab world’s largest economy.

IT department raids premises owned by group running Srinagar’s biggest private hospital

srinagar it raid

The Income Tax Department conducted a search-and-seizure operation on February 19, on a group running the biggest private Multi-specialty Hospital in Srinagar. Seven premises including four residential premises, all in Srinagar, were raided.

The core business of the group includes running of the hospital, real estate & trade in household consumables.

Cash of ₹82.75 lakh and jewellery and bullion worth ₹35.7 lakh have been seized. A bank locker connected with the group has been sealed as well.

Suppression of receipts from the running of the hospital is under investigation. The average turnover shown by the Hospital is around ₹10-12 crore since FY 2015-16. However, evidence seized in the raid shows actual receipts to be at least four times more the value. Evidence showing cash payments of ₹3 crore, made to various doctors in the current year, has been seized during the search.

Evidence of various benami properties has also been unearthed and seized during the search.

The group has so far made unaccounted property transactions worth more than ₹100 crore in cash since FY 2013-14.

The group is in the practice of buying large chunks of lands in piecemeal and aggregating them. Thereafter, it develops the land and carves out plots and sells them. Evidence showing more than 50% of consideration (over & above the registered value of the property) received in cash from buyers, has been seized during the search operation. Taxes were not paid in such sale considerations received in cash. The payments and investments made through banking channels by the buyers of the plots are also under investigation as prima-facie verification shows that the investments have not been made using tax-paid income. Thus, taxes will be leviable not only on the sellers but the buyers as well, depending on what the investigations reveal.

Furthermore, the search has revealed substantial evasion of stamp duty due to the State Government/Union Territory on the cash that paid as sale consideration over & above the registered value of the property.

The search also disclosed that the individuals have received plots of land as gifts from various unrelated individuals, and no income has been shown on this score under section 56 of the I. T. Act, 1961. The cases of the donors are also under investigation from the perspective of potential evasion of income tax.

One individual involved in the group running the multi-specialty hospital, who is engaged in a trade of household consumables, has made cash purchases of household consumables worth ₹2 crore in six months of FY 2019-20, in violation of the mandate that payment of more than ₹10,000 at a time in such purchases has to be done through banking channels only.

Further investigations are ongoing.

Bombay HC grants bail to Maoist ideologue and poet-activist Varavara Rao

varavara rao

On Monday, the Bombay High Court granted bail to poet-activist and Maoist ideologue Varavara Rao in the Elgar Parishad-Bhima Koregaon case on medical grounds. 81-year old Rao has been charged under the Unlawful Activities (Prevention Act (UAPA) for his alleged involvement in the Elgar-Parishad-Bhima Koregaon violence.

The court observed that there were inadequate facilities in the Taloja jail hospital ,where the octogenarian Marxist-Maoist activist has been lodged. It was a “genuine and fit” case for granting bail, the court added, in view of Rao’s advanced age.

The National Investigation Agency (NIA) had asked for Rao’s release to be put off for three weeks, which the bench comprising Justices SS Shinde and Manish Pithale refused.

“Crime of conscience”?

Pendyala Hemalatha, Rao’s wife, had petitioned that her husband’s fundamental rights to health, dignity and life, and therefore his rights under Article 21 of the Constitution had been violated.

Indira Jaising, the advocate appearing for Rao and Hemalatha, argued that Varavara’s crime was “in his mind”. “His crime is in his mind, it’s a crime of conscience. If he disagrees with the policies of the government… he does. If for that he is prosecuted, it will be prosecution for ideas”, she had argued.

Throughout his life, Varavara Rao has been associated with Marxist and Maoist groups who often advocated a violent, revolutionary overthrow of government. Rao was deeply influenced by the Naxalbari uprisings in West Bengal, which also inspired waves of violence in Rao’s home-state of Andhra Pradesh. Pune police had even arrested Rao in connection with an alleged conspiracy to assassinate Prime Minister Modi in June 2018.

Varavara Rao was arrested on August 28, 2018 for his alleged involvement in the Bhima-Koregaon violence on January 1, 2018. An FIR filed in Pune alleged that on the eve of the 200th anniversary of the Battle of Bhima Koregaon, an evening programme called Elgar Parishad had been organised, in which noted Leftist activists and underground Naxalite groups had participated. Police claimed that speeches delivered at the event on December 31, 2017, were partly responsible for inciting violence the next day.

Among others arrested in the Elgar Parishad case, under the Unlawful Activities (Prevention Act (UAPA), are activists Rona Wilson, Arun Ferreira, Sudha Bharadwaj , Gautam Navlakha and Anand Teltumbde. Repeated bail appeals by Rao on the ground of his failing health have been rejected in the last 22 months.
