Residents of several localities around the Thiruparankundram hill on Sunday lit lamps and hoisted yellow Murugan flags outside their homes, reiterating their demand that the traditional Karthigai Deepam be lit at the Deepathoon on the hilltop.

Women in Pamban Nagar, Karumariamman Kovil Street, Shakthi Vinayagar Kovil Street, Balaji Street, Velli Malai Street, Rajiv Gandhi Nagar and surrounding areas tied rooster flags bearing the image of Lord Murugan in front of their homes. They lit rows of lamps and held a collective prayer, urging the Tamil Nadu government and the Hindu Religious and Charitable Endowments (HR&CE) Department to implement the court order permitting the Deepam to be lit at the summit.

The residents also emphasised that their ongoing protests – lighting lamps, hoisting Murugan flags and recording videos of their demonstrations are expressions of long-standing local sentiment. They asserted that attempts to portray the demand for hilltop Deepam lighting as agitation by Hindutva groups or external forces were misleading, stating that devotees who live around the hill have consistently sought adherence to the traditional practice.

Locals said the videos emerging from the neighbourhood clearly show that the demand is rooted in community participation and long-held custom.

A controversy has emerged over documents submitted by the Tamil Nadu Hindu Religious and Charitable Endowments (HR&CE) Department during court proceedings related to the Thiruparankundram Deepathoon issue, after a senior priest publicly denied issuing a statement attributed to him.

According to submissions made in court, the HR&CE Department had reportedly included letters from several priests to support its argument that the lamp cannot be lit on days other than Karthigai Deepam.

One of the letters cited was attributed to Sivasri Pitchai Gurukkal, who was quoted as saying that, as per “Sivagamams,” it is customary to light the Deepam only on Karthigai Deepam day and not on any other date.

However, after the contents of the purported letter began circulating in the media, Pitchai Gurukkal issued a public clarification, stating that he had not provided the information claimed in the document. Responding to the claims, he alleged that his name and authority were used without his consent: “The Department has submitted as a letter information that I never gave,” he said.

This contradiction has triggered sharp reactions from Hindu organisations and opposition groups, who have questioned whether the HR&CE submitted inaccurate or fabricated material before the court. They have also accused the department of attempting to influence judicial proceedings to prevent the lighting of the lamp at Thiruparankundram’s Deepathoon.

The Hindu Munnani on Friday, 5 December 2025, announced that it will hold protests across all districts of Tamil Nadu on December 7, condemning the denial of permission to light the lamp at the Thiruparankundram Deepathoon.

Speaking to reporters in Tiruppur, Hindu Munnani state president Kadeshwara C. Subramaniam said the organisation was protesting what it described as the Tamil Nadu government’s “insult to the devotion of the people” over the past two days. He alleged that despite clear High Court directions, the police had acted “against the Constitution” and accused the government of attempting to divert attention from what he termed the DMK’s “anti-Hindu activities.”

Subramaniam said the police’s failure to implement the High Court order amounted to dereliction of duty. He cited earlier court rulings, including a 1996 order permitting the temple administration to light the lamp on Thiruparankundram hill and a 2014 ruling stating that the lamp could be lit anywhere on the hill. He further said that in 2015 the dargah administration had informed the court that it had no objection to the lighting of the lamp.

According to him, the present case, filed against the temple administration and the Hindu Religious and Charitable Endowments (HR&CE) Department, stemmed from non-implementation of court directions “for nearly 30 years.”
He also criticised Law Minister S. Raghupathy, alleging that the minister had given “incorrect information” regarding the court proceedings.

Subramaniam accused the DMK government of selective secularism, claiming that while it greets festivals of other religions, it does not extend greetings for Vinayagar Chaturthi or Deepavali.

Rejecting accusations of provocation at the Thiruparankundram site, Subramaniam said the Hindu Munnani had not instigated religious tension and alleged that police mishandling contributed to the unrest. He described law and order in Tamil Nadu as “poor” and claimed that the government had “taken over” Thiruparankundram to divert attention from its failures.

Announcing the December 7 statewide protest, he said it would be held to condemn what the organisation calls the “anti-people and illegal activities” of the DMK and to demand immediate permission for lighting the Deepam. He also alleged corruption in temple administration and criticised the state government for not initiating action.

State secretary Kishore Kumar and other functionaries were present at the press interaction.

The DMK government in Tamil Nadu on Thursday, 4 December 2025, filed a Special Leave Petition (SLP) before the Supreme Court challenging the Madras High Court’s order quashing the prohibitory order issued by the Madurai District Collector in the Thirupparankundram region.

The Collector had invoked prohibitory measures after clashes reportedly broke out during the implementation of a High Court directive issued on Wednesday, which permitted devotees to visit the temple and light lamps at the Deepathoon (stone pillar).

Government sources told The New Indian Express that the State would seek an urgent hearing on Friday, 5 December 2025. However, according to the Supreme Court causelist available until 10:50 p.m. Thursday, the matter is not listed for Friday.

A lawyer associated with the case, who did not wish to be named, described the issue as “highly sensitive” and declined to share further details. The lawyer said, “Please wait until Friday at 10:30 a.m.”

Earlier on Thursday, Justice GR Swaminathan of the Madurai Bench quashed the State government’s prohibitory order, holding that it had been issued solely to circumvent the implementation of the court’s directive. The Bench also directed the Madurai City Commissioner of Police to provide protection for devotees lighting lamps at the Deepathoon located on the lower hilltop.

The State has now approached the apex court seeking to challenge the 4 December 2025 judgment.

The Madras High Court’s Madurai Bench on Thursday, 4 December 2025, took serious exception to the conduct of the Thirupparankundram temple’s Executive Officer and the Madurai District Collector after they failed to appear before the court during the hearing of a contempt petition related to the non-lighting of the court-mandated Karthigai Deepam at the Deepathoon atop Thirupparankundram Hill.

The matter was heard by Justice GR Swaminathan, who earlier had permitted the petitioner and ten others to light the Deepam under CISF protection after the temple administration failed to comply with his December 1 order.

“You were blessed by the order”

At the start of the hearing, Senior Advocate N. Jothi submitted, “We’ve suffered the court’s order.”

Justice Swaminathan replied in lighter vein: “You did not suffer with the order. You were blessed by the order.”

Court Warns of Harsher Order if Officials Fail to Appear

Expressing displeasure over the absence of the Executive Officer and District Collector, the judge said: “I’ll reassemble at 5:30 p.m. If they do not appear (through VC) by then, I’ll pass a harsher order.”

When the bench reconvened, Madurai City Police Commissioner appeared via video conference.

Court Confronts Police Commissioner

Justice Swaminathan questioned him directly:
“I’m posing a direct question to you. What do you do when there’s a court order?”

The Commissioner responded that he had the “highest regard for the court” but explained that a huge crowd, destruction of barricades, and a resulting law-and-order situation had necessitated the promulgation of a Section 144 order.

The judge then inquired about the exact time at which the Commissioner wrote to the District Collector seeking imposition of Section 144.

State Government’s Arguments

Additional Advocate General (AAG) Veera Kathiravan denied deliberate disobedience: “We never intended to disobey the court order. We know the order has come, but the LPA is permitted.”

AAG J. Ravindran urged the court to wait for the writ appeal scheduled for the next day: “At this stage, I don’t want to go into the merits. My only request is that tomorrow writ appeal is coming. Let us wait for the appeal.”

Court Recaps Events & Criticises Police Action

In delivering the order, Justice Swaminathan recalled that his direction from the previous day had allowed the petitioner and CISF to go ahead with the lighting of the Deepam. However:

The Commissioner restrained the petitioners and CISF from proceeding.

He informed them that due to Section 144, he was “not in a position to respect the order of court.”

CISF personnel then returned, and the petitioners were prevented from lighting the Deepam despite explicit permission.

Division Bench Appeal Dismissed

The court recorded that the State’s appeal to the Division Bench had been dismissed earlier in the day through a detailed order, meaning the single judge’s directions continued to remain operative.

Court Quashes Section 144 Order

Justice Swaminathan observed that the Commissioner appeared to believe he ranked above the High Court, remarking: “The Commissioner may think he is superior in ranking than HC judge.”

He added that the Commissioner attempted to justify his actions by citing the District Magistrate’s Section 144 order.

The judge reiterated that “constitutional court’s order can be set aside only in manner known to law. As long as it’s standing, it has to be obeyed by all officers.”

Finding that the Section 144 order had been invoked only to obstruct implementation of the High Court’s directions, the judge quashed it.

Court Directs Police to Ensure Lamp Is Lit Today

Justice Swaminathan concluded by directing the Madurai City Police Commissioner to:

  • Provide police protection,
  • Allow devotees to light the Deepam at the Deepathoon today,
  • And warned that strict action would follow if the order was not complied with.

The hearing was then brought to a close.

Even as tensions rose at Thirupparankundram over the non-lighting of the court-mandated Deepathoon lamp, fact-checker Mohammed Zubair triggered fresh controversy by posting what critics say was a misleading “fact-check.” Zubair cited footage of the traditional Uchchipillaiyar lamp to claim the ritual had taken place, despite the High Court’s order applying specifically to the Deepathoon where the Deepam remained unlit.

India Today journo Akshita Nandagopal shared a video of the protests that took place following the non-compliance.

Zubair Shares Broadcast Screenshot, Misleads Public

Amid reports of non-compliance and subsequent protests, Mohammed Zubair shared a screenshot of a Tamil news channel’s post showing the lamp lit at the Uchchipillaiyar Temple in response to India Today journo’s video of the protests. He implied that claims of non-lighting were “fake news” and that the ritual had indeed taken place.

However, critics pointed out that the screenshot Zubair shared depicted the traditional lamp, not the one mandated by the High Court at the Deepathoon. By omitting this distinction, his post suggested that protesters and commentators falsely claimed the ritual was not performed, when in reality they were referring to the court-directed second Deepam at a different location.

Multiple netizens called out his lie that created the impression that Hindu devotees had instigated chaos despite the lamp being lit when the specific Deepathoon lamp remained unlit in violation of the court order.

 Court’s Order vs. Social Media Narrative

The Madras High Court had instructed temple authorities to ensure that the Deepam was lit at the Deepathoon and even stated that if authorities failed to comply, the petitioner and ten others could light the lamp under CISF protection. As the directive was not carried out, devotees demanded enforcement, leading to clashes and the imposition of Section 144 in the area.

Zubair’s post obscured this context and reinforced a narrative suggesting that the protesters acted without basis.

Following Zubair’s post, several legal commentators, journalists and devotees accused him of misleading the public by conflating two separate ritual sites and misrepresenting the core issue that triggered the unrest.

They noted that the High Court’s direction was unambiguous:

  • Lamp at the usual site (Uchchipillaiyar) → Already a tradition
  • Lamp at the Deepathoon → Court-ordered and not performed

By circulating an image of the former, Zubair implied compliance where there was none.

Madurai district police have registered a case against 15 individuals, including members of the Hindu Munnani and BJP functionaries, following clashes on Thirupparankundram hill over the lighting of the Karthigai Maha Deepam. The incident unfolded amid a series of rapid legal, administrative and on-ground developments triggered by a Madras High Court order permitting hilltop lighting under CISF protection.

Court Order Sparks Protests

The issue began after a single judge of the Madras High Court’s Madurai Bench, Justice GR Swaminathan, granted permission to light the ceremonial lamp on a specific lamppost at the hilltop near the Sikandar Dargah, apart from the long-standing practice of lighting the Deepam at the Uchipillayar Temple.

Although the temple administration initially prepared arrangements at the hilltop, these were cancelled yesterday morning. The reversal sparked protests from several groups including the Indu Makkal Katchi, Akhil Bharat Hanuman Sena and the South India Forward Bloc.

As the 6 PM deadline set by the court approached, the lamp was lit only at the traditional Uchipillayar Temple site. In response, Justice Swaminathan issued an extraordinary directive allowing the petitioner and ten others to proceed with CISF escort to the designated lamppost at the hilltop to light the Deepam.

Tension Escalates, Section 144 Imposed

Following the order, several Hindu organisations and BJP members assembled, demanding enforcement of the hilltop lighting directive. When protesters attempted to break through police barricades to climb the hill, clashes erupted. Two policemen sustained injuries, prompting a rapid escalation of security measures.

District Collector Praveen Kumar subsequently imposed prohibitory orders under Section 144 of the CrPC across the area. A number of protesters who violated the ban were detained. Before dispersing, some demonstrators lit a fire along the hill path and performed worship rituals on the ground.

FIR Against 15 Individuals

Thirupparankundram police later registered a case against 15 people, including BJP state youth wing secretary SG Suryah. The charges include trespassing, disturbing public peace, and damaging public property; seven IPC sections in total.

Parallel Legal Battles in High Court

Meanwhile, the legal contest intensified at the Madurai Bench of the High Court.

The Additional Chief Public Prosecutor has filed an appeal before the Administrative Judge seeking to quash Justice Swaminathan’s order. The appeal has been admitted and is listed as the first case this morning.

Separately, a petition has been filed on behalf of District Collector Praveen Kumar seeking a stay on the contempt petition filed by original petitioner Rama Ravikumar, while also challenging the single-judge order.

Both matters will be heard today by a division bench comprising Justices Jayachandran and Ramakrishnan.

With Section 144 in force, public and devotees remain barred from accessing the hill, though the temple continues normal darshan and shops in the locality remain open. Police security in and around Thirupparankundram has been significantly increased as legal proceedings continue and tensions on the ground remain high.

In a significant ruling, the Madurai Bench of the Madras High Court has permitted the lighting of the Karthigai Deepam at the original summit-lamp pillar atop Thirupparankundram hill on December 3, reviving a tradition that was halted during World War II under British-imposed safety restrictions.

The order was delivered while hearing a batch of petitions filed by Hindu Makkal Katchi members Rama Ravikumar and Solaikannan, who sought revival of the traditional ritual at its historic hilltop location.

For decades, the Deepam has been lit on a lower pillar near the Thirupparankundram temple, even though the historic “Deepa Thoon” at the hill’s summit was the traditional site.

The restriction dates back to 1912, when a legal case led to a prohibition on Hindus lighting the ceremonial lamp at the peak. Since then, the Deepam has been lit at an alternate spot known as the Moksha Deepam, a deviation that has long angered devotees who view it as a violation of their religious rights and an erosion of an ancient custom.

The petitions challenged the Subramaniya Swamy Temple administration’s decision to light the Deepam at the Deepa Mandapam, arguing it violates Agama Shastra principles and lacks historical precedent for that location. Petitioners claimed the summit pillar offers better visibility for devotees and aligns with ancient customs, citing 1862 and 1912 magistrate orders that restricted lighting elsewhere due to non-customary practices and potential law-and-order issues. They emphasized no communal risks, as the site is protected and monitored.

The court’s decision came in response to a petition seeking restoration of the original practice, arguing that no legal prohibition exists and that lighting the Deepam atop the hill carries greater spiritual significance and wider visibility.

The petitioners also highlighted that the summit pillar stands over 15 metres away from the nearby dargah, addressing concerns about religious sensitivities.

Temple authorities, supported by the Hindu Religious & Charitable Endowments Department and the Tamil Nadu Waqf Board, argued in favour of continuing the ritual at the lower pillar, citing logistical challenges and established practice.

After conducting a site inspection and hearing submissions from all sides, the High Court ruled that the centuries-old tradition should be restored. The bench held that there was no legal impediment to lighting the Deepam at the summit pillar and directed that the ritual be carried out there on December 3.

The order marks the reinstatement of a revered custom at one of Tamil Nadu’s oldest and most important Murugan shrines, ending a decades old dispute in the hilltop lighting of the Karthigai Deepam.

In October 2025, the Madras High Court – Madurai Bench issued a landmark order banning the sacrifice of goats and chickens, and prohibiting the cooking or serving of non-vegetarian food on Thiruparankundram Hill. The court also declared that the hill should no longer be referred to as “Sikandar Hill.”

The Madurai Bench of the Madras High Court has broadened the scope of a legal dispute concerning the location for lighting the Karthigai Deepam on Thiruparankundram hill by making the Hindu Religious and Charitable Endowments (HR&CE) Department and the Tamil Nadu Waqf Board parties to the case. The court has adjourned the hearing to 27 November 2025, directing all parties to file their responses.

The litigation stems from a batch of petitions challenging the decision of the Subramaniya Swamy temple authorities to light the ceremonial lamp at the ‘Deepa Mandapam’ near the Uchipillaiyar temple. The petitioners, including Rama Ravikumar and Solaikannan of the Hindu Makkal Katchi, have contested this, alleging that the ‘Deepa Mandapam’ is traditionally used for the ‘Moksha Deepam’ ritual and cannot be used for Karthigai Deepam.

They have claimed that the Karthigai Deepam was historically lit on an ancient stone pillar located about 15 metres away from the Sikandar Badushah Dargah on the hilltop, arguing that this location offers greater visibility.

Justice GR Swaminathan, who is hearing the petitions, had previously taken suo motu cognizance to include the Dargah authorities and the Archaeological Survey of India (ASI) in the proceedings. In a significant step, the judge personally inspected the contested spots on the hill on 19 November 2025.

During the hearing on Monday, arguments intensified. The counsel for the Dargah cited a subordinate court judgment from 25 August 1923, which declared that the Nellithope and the entire hilltop where the mosque and its flag staff are situated belong to the Muslim community. He further pointed to historical precedents from 1862 and 1912, where attempts to light the deepam at the summit were interdicted by the magistrate on grounds that it was not customary and due to apprehensions of a breach of peace. The Dargah’s counsel argued that the petitioners’ remedy lies before a civil court.

These contentions were supported by another advocate, who appeared in support of the temple authorities’ decision to use the Uchipillaiyar temple site. This advocate also sought an interim direction for police protection at the hilltop.

However, the petitioners’ counsels opposed these arguments, maintaining that the stone pillar is situated at a distance from the Dargah and that lighting the lamp there would not disturb religious harmony.

Arguments on Custom, Property and Worship Law

An intervenor argued that under the Places of Worship (Special Provisions) Act, the site must remain as it existed in 1947, meaning the Deepam should be lit at the earlier location. Justice Swaminathan clarified that the Act applies only to places of worship and not to property disputes.

Another intervenor raised concerns about communal harmony ahead of elections. The judge said such apprehensions were unrelated to the legal question before the court.

Appearing for the All Caste Archakas’ Association, advocate Vanchinathan argued that the temple administration’s decision to light the Deepam near the Uchipillaiyar Temple had already been affirmed by a Division Bench and did not warrant interference. He reiterated that there was an existing order recognising Dargah ownership of the hill’s summit.

Justice Swaminathan noted that Thirupparankundram hill has multiple peaks and remarked that maintaining social harmony is the responsibility of the government, not the court.

The judge then impleaded the HR&CE Commissioner and the Tamil Nadu Waqf Board as respondents, directing all parties including temple authorities, the Dargah, ASI, intervenors, and newly added respondents, to file counter affidavits.

The case has been adjourned to November 27 for further hearing.

The Hindu Munnani has called upon devotees to light the Karthigai Deepam atop Thiruparankundram hill this year, asserting that the temple administration has failed to implement a court order allowing the traditional practice.

In a statement, the organisation’s state president, Kadeshwara Subramaniam, said the Karthigai Deepam festival has been celebrated in Tamil Nadu since ancient times, with the lighting of the sacred lamp atop the Thiruparankundram hill, considered the first abode of Lord Murugan, being an integral part of the tradition.

He noted that during World War II, the British authorities banned the lighting of the Deepam on the hilltop for security reasons, leading to the practice being shifted to a pillar in front of the temple. “That temporary arrangement continues even today,” he said.

Subramaniam recalled that the late Hindu Munnani founder Ramagopalan had fought a legal battle seeking restoration of the original custom, and that a court verdict was delivered in favour of lighting the lamp atop the hill. However, he alleged that the temple administration has failed to carry out the order despite the judgment being in place for years.

“Worship is our legal right, and the court has already confirmed it. It is condemnable that the temple administration still refuses to allow the lighting of the Deepam at its rightful place,” Subramaniam said.

Calling for mass participation, he urged Murugan devotees, spiritual groups, foot processions, and kavadi bearers to gather in large numbers at Thiruparankundram hill on 30 November 2025 (Sunday) at 3:00 PM to light the Thirukarthigai lamp and uphold the tradition.

He said the event would also serve as a symbolic act to “protect dharma” and to demand enforcement of the court’s directive permitting the lighting of the Deepam atop the sacred hill.
