A magistrate court in Mumbai has ordered the police to probe a complaint against actress Payal Rohatgi for allegedly spreading hatred towards a particular community through her tweets on anti-CAA activist and Jamia Student Safoora Zargar.

Metropolitan magistrate, Andheri, Bhagwat Zirape on March 30 ordered an enquiry against the actress under section 202 of the Criminal Procedure Code (CrPC) and a copy of the same was made available on Monday.

“Every community has the right to profess its religion. No individual has the right to make a fun of any custom or rites of other communities,” the magistrate noted in his order.

Anti-CAA activist got bail relief as she was pregnant when imprisoned

27-year old Zargar, an MPhil student from Jamia Milia Islamia University was languishing in prison in connection with the Delhi Riots case. Zargar was pregnant at the time. Rohatgi’s tweet was in response to a post by a journalist who wished to sympathetically portray Zargar’s situation at the time. Zargar, was subsequently granted bail on humanitarian grounds.

Rohatgi’s tweets mentioned the Quran, the practice of Female Genital Mutilation, and sought to know if there were no condoms at the medical shop.

Based on the tweets, advocate Ali Kaashif Khan Deshmukh first approached the Amboli Police for registration of an FIR. When the police refused to take cognisance of the complaint Deshmukh approached the Andheri Court, in December. In his complaint, the lawyer had stated that Rohatgi’s tweets were “exceedingly derogatory” to the people of a particular community and her post defamed its women.

In its ruling, the Court observed that the tweets prima facie show disregard against Muslim women and the community as a whole. It added that a technical investigation regarding the tweets is necessary to proceed against the accused.

A probe under section 202 of the CrPC is ordered to determine whether a prima facie case is made out and whether there is sufficient ground for proceeding against the accused.

The court has asked the police to submit its enquiry report on April 30.

The Legal Rights Observatory (LRO), a legal activism group working to safeguard Indian interests has exposed that the NGO of ‘activist’ Colin Gonsalves, the Human Rights Law Network (HRLN), received funds to the tune of about ₹50 crore from foreign Christian organizations. These funds have been used for defending rioters who created ruckus during the anti-CAA agitation in court. 

In a series of tweets, LRO exposed the nexus between church organizations that send money from abroad and ‘activists’ in India like Colin Gonsalves who use that money for peddling an anti-Indian agenda.

Colin Gonsalves became popular for his witch-hunting against PM Modi after the 2002 Gujarat riots. Now Gonsalves has emerged as one of the conspirators behind the anti-CAA riots across India.

The revelation by LRO has exposed the deep affiliation between Church and various NGOs working in India under the garb of human rights. 

The Church denominations which have been exposed for funding unrest in India through HRLN are: Bread for the World Germany (Protestant), DKA Austria (Catholic), MISEREOR (German Catholic), Karuna TrustUK (Dalit- Buddhist) INCLO (13 NGOs) and Belgium HQ European Commission.

These Church organizations had funded HRLN as patrons of its ‘Socio-Legal Information Center’ to provide legal support and defend the rioters in court. 

Just a few days back, the government had cancelled the Foreign Exchange Regulation Act (FERA) of many NGOs who were allegedly involved in an evangelical expedition in tribal areas to convert them to Christianity.

The website run by HRLN openly claims that its lawyers defended stone pelters, rioters, arsonists and criminal elements involved in anti-CAA riots across the country.

Safoora Zargar, the prime riot accused was also defended by HRLN. According to LRO says that utilisation of foreign funds for anti-India activities is a direct violation of FCRA Section 12A(4)(V)(VI) and 12(4B) 1,2,3,6 and have written to the Union Home Ministry for the arrest and prosecution of Colin Gonsalves and other directors of HRLN by invoking UAPA against them.

The HRLN appoints retired Supreme Court judges as directors or on its board to manipulate and influence the justice process so as to get a favourable judgement for its litigants. Most of its trustees are either retired judges or belong to the academia.

The HRLN is fighting for the POCSO accused Mohammad Zubair of AltNews who had shared a picture of a minor girl to target a user on Twitter.  

The LRO has called for slapping sedition case and the Unlawful Activities (Prevention) Act against Gonsalves and the cancellation of FCRA license for HRLN.

The High Court on Tuesday granted bail to Safoora Zargar, a pregnant student who was arrested for instigating violence in Jamia University during the CAA-NRC riots in December. The verdict was issued stating humanitarian grounds and emphasised on the fact that this should not be set as a precedent for similar issues in the future.

Justice Rajiv Shakder, who issued the verdict, said that she was released on furnishing a personal bond of ₹10,000 as a surety amount and that she should not be indulging in any such activity for which reason she was charged in the first place.

Safoora Zargar, 27, was arrested on April 10 on conspiracy charges over the riots that broke out in February during protests against the Citizenship Amendment Act. She was granted bail but rearrested on more severe charges under the Unlawful Activities (Prevention) Act. Her arrest and incarceration provoked strong condemnation from students and activists and sharply divided social media.

She was let out on humanitarian grounds stating her delicate health due to her stage in pregnancy, although, it further claimed that she was allegedly part of the premeditated conspiracy to incite communal riots in northeast Delhi in February.

Communal clashes had broken out in northeast Delhi on February 24 after violence between citizenship law supporters and protesters spiralled out of control leaving at least 53 people dead and scores injured.
